Since 13 th March 2016, in terms of the new National Credit
Amendment Act, it is illegal for a company to contact a consumer and
demand that they pay a prescribed debt.
If, in the past three years, you have not: made any payment towards
settling a debt, acknowledged owing the money in any way or agreed
to pay it, or been summonsed in respect of it, it has prescribed,
and you can raise this as a defence when asked to pay such a debt.
The debt-collecting company or legal firm should close its file on
you at that point. Some do, but others continue with the harassment
via SMS, letter or email.
A threat which works well on most consumers is the one about being
“blacklisted”, because it’s difficult to live without access to any
form of credit.
But the National Credit Act prohibits
the listing of a prescribed debt.
It follows, then, that it’s unethical for debt collectors to use the
threat of “blacklisting” in making demands for payment.
This person and Company has been referred
to the NCR for Criminal Prosecution.

I was a Black Bastard’’ . You also stated that
you would ‘’ come and look for me’’.
It was clear that you were either sick or needed
help for your problem
You also stated that you were a partner of Cliff
Dekker Hofmeyr and how important you were and
that that nobody ‘’f---s with you’’
PEP, N & S, ISPE are Registered in the USA,
and are domicile in the USA.
You are welcome to take the matter further and
we would welcome such an action in an American
Court.
I have given instructions to extend the
blacklisting to all our WEB sites ( 96 of them
in 60 countries / states ) and to Google your
name and send it to 550 search engines. You and
your client can have some legal fun with this.
However stop wasting your Clients money, and
give them some Professional Advice, to settle
their Outstanding bill and also Apologise for
the 3rd World Service they offer the
South African Public, and return the domain that
they have stolen. This would not be acceptable
in the Free World, and First World countries.
We trust that you have not charged your Client
for your legal service to date, because it seems
to be very unprofessional..
We look forward to your client transferring the
said outstanding sum and the additional Invoice
which will be emailed to them.

am a board Member of the International Society
of Professional Engineers, a Board Member of the Union Internationale Des
Ingenieurs Professionnes and a
Berufsingenier in Deutschlands.
I had a call fron a Eben van Wyk who was very
aggressive, incoherent and proceeded to inform me that he was
a Senior Partner of Cliff Dekker Hofmeyer and I
should know how important he was.
He demanded
that I remove his Clients Blacklisting ( MWEB )
from a site that is not Controlled or
owned by myself. He seemed to be confused about
the International Legal System on Domains etc.
Her stated that if I did not remove his clients
Blacklisting he would sue me and destroy me and even
have me F----d up.
He would come looking for me and have me
hunted down by his contacts from Cape Town
He is clearly a very dangerous man, and I will
take the precautions required in view of this
serious threat. Costs will be for MWEB.

him.
He
was slurring his words and very aggressive his as if he was
drunk. I am taking precaution and will now carry a firearm because
he appears to be very dangerous and violent man

Concourt takes ‘high-price’
counsel down a peg or two
THE Constitutional Court has spoken out about
its “disquiet” over how counsel’s fees have
“burgeoned in recent years”.
In a judgment handed down yesterday, the 11
justices of the Concourt slashed the amounts a
senior advocate and his junior could charge one
of their clients.
The judgment deals only with legal costs, which
relates to a leave to appeal application that
was heard before their court two years ago. The
original dispute, however, stems from a lengthy
legal clash over a sea view in Camps Bay.
It was effectively a bid by Camps Bay resident
Anthony “Buddy” Herman to prevent his neighbour,
Gerda Harrison, from building a three-storey
house that would interfere with his view.
However, Herman lost the battle. In November,
2010, the Concourt denied leave to appeal
against a high court ruling and ordered the
applicants – the Camps Bay Ratepayers’ and
Residents’ Association and PS Booksellers – to
pay the respondents’ legal costs for the
application.
But Herman, who is also an attorney and
represents the applicants, said they objected to
the legal costs for Harrison’s two counsel.
According to the 2010 Concourt judgment, the
advocates representing Harrison were Henry
Viljoen, SC, and JC Marais.
They originally charged R453 150 and R263 500
respectively. Following the applicants’
objection, however, the court’s taxing master
had cut this down by almost half to R240 000 for
Viljoen and R160 000 for Marais.
The losing party, in this case the applicants,
were still not happy and sought a review of the
taxing master’s decision, which gave rise to
yesterday’s Concourt judgment.
The justices found that the amount awarded was
“so disproportionate to what is fair and
reasonable” that it had to be set aside. They
again slashed the legal fees, this time to R180
000 for Viljoen and R120 000 for Marais.
“We feel obliged to express our disquiet at how
counsel’s fees have burgeoned in recent years.
“To say that they have skyrocketed is no loose
metaphor,” the judgment read.
“No matter the complexity of the issue, we can
find no justification, in a country where
disparities are gross and poverty is rife, to
countenance appellate advocates charging
hundreds of thousands of rands to argue an
appeal.”
The justices also tipped their hats at the many
“accomplished and hardworking” advocates who
took on cases pro bono and charged special rates
for indigent clients.
