This is a another Firm of Shady Attorneys  - Stanley Brodkin Maditse who will lie in Court Papers, make false statements, bribe the Sheriff, to secure Judgements without delivering Court Papers.

What do we do with Corrupt or Dishonest Attorneys ? 

Back in the mid 80’s into the early 90’s, Standard Bank used Attorney Peter Soller ( Deceased ) of Soller Weiner and Partners  to secure judgements and Liquidation orders against Standard Bank clients, without the Delivery of the Summons, just delivering the final order. ( Soller had the Sheriff on his Payroll ).

They used a liquidator, Ben De Wet of Kaap Vaal Trust, who stole millions of Rands with the help of Aucor, from Standard Bank Clients.

Standard Bank were aware of the facts and the Corrupt practices, hence using Peter Soller. 

Peter Soller was struck off the Roll of attorneys in 2002 by Judge Eberhardt Bertelsmann and Judge William de Villiers  ‘’as a danger to his Clients and the Public’’ and later ‘’as a danger to Society and an embarrassment to the Profession‘’. 

The year is 2012 and Standard  Bank and their Attorneys Stanley Brodkin Maditsi in Johannesburg are at it again.

Standard Bank had a Constitutional Court Ruling against them a few weeks ago for failing to advise Clients of default in terms of NCR Act Section 129 0f Act 34 of 2005 (delivery of Notices and Proof thereof).  Top Judges have various views and it would seem that their views change on how they feel on a particular day!  

Standard Bank’s firm of attorneys ( also acting for ABSA and FNB ) are filing documents daily in our courts, making false statements as regards Clients addresses, and in fact breaching the FICA Act as well. (The Clients have FICA’ed Correctly with Standard Bank )

Judgements are obtained without documents being delivered. ( You can buy a Return of Service from the Sheriff of the Court without the Delivery of a Summons for R 200-00 ) 

One Firm of attorneys in Randburg, gives a non Existent Address on the summons so that you cannot contact them. They also have no Back up documents if you dispute the matter, as the Bank’s records seem to be in a shambles. The Clerk of the Court will stamp anything you put in front of them! 

We all know that there is no point in reporting them to the Law Society, as very little action is ever taken. The NCR and the NCC  Consumer Commissioner ( She has her own problems with her employment contract.  In fact Rob Davies fired her today!) are a waste of time. 

Should we start Compiling a list of Dishonest attorneys who breach the law  or are we going to sit back and do nothing, which seems to be the norm in South Africa.

We will see the Peter Soller history repeating itself unless we do something like ‘Naming and Shaming’ them.

Robert Andre Laubscher - Director of Strauss Daly  - Pretoria Jointly and Severally with Mercedes Benz Financial Services deliberately with the intention of Causing embarrassment  to a Client which we believe was racially motivated, attached  confidential and sensitive Information via an open letter, on the letter head of the firm Strauss Daly Attorneys to the main security entrance  gate of the complex situated at  Rivonia, which you were not authorised to do. The said document was stapled to the gate. 

This is in contravention of Section 68 of the National Credit Act 34 0f 2005  and various sections of the Consumer Protection Bill 68 of 2008 and in direct violation of the Constitution of the Republic of South Africa Act 108 0f 1996 and its various amendments. 

It is Clear that  Robert Andre Laubscher Director Strauss Daly  - Pretoria and Mercedes Benz Financial Services have a no care attitude to the National Credit Act,  Consumer Protection Bill 68 of 2008, and is in direct violation of the Constitution of the Republic of South Africa Act 108 0f 1996 and its various amendments. 

A detailed Complaint has been prepared and will be filed with the National Consumer Commissioner ( NCC )  and the National Credit Regulator.( NCR )  This Carries Fines and Penalties of R 5,000,000-00 and or 10% of the turnover of the Organisation.

We will press the regulator to fine both parties the amount of 10% of their turnover

Criminal Charges have been laid against Attorney Robert Andre Laubscher and Mercedes Benz Financial Services for hiring a professional Hit man a  Mr Ricky Mannie armed with a firearm with instructing to Break in the private residence of the Owner of the home who is not Connected with either Organisation in any way.

At 12:15 a Mr Ricky Mannie ID No D no 621115512082.of Tim Risk management on the Instructions of Mr Robert Andre Laubscher and Mercedes Bens Financial Services armed with a firearm overrode the Perimeter Security System and  broke into the premises of a long standing client of Mercedes Benz.

The Safety  and Security of the Family was jeopardised in the Attack. It is Clear that this Attorney has a no care attitude to the laws of the Land. 

The Hit man tried to escape by reversing at high speed down the driveway and was apprehended at 12:19 in the Driveway. He stated that he was working for Mercedes Benz Financial Services and Strauss Daly.

His Car Revealed that :

He had House Breaking Equipment and tools in the Car.

He was in possession  of Remote Control Devices and Car Jam- locking System devices.

He had an Electronic Scanner in his car for overriding Alarm Systems.

He stated that he worked for Mercedes Benz and on inspection he was carrying an ID no 621115512082.

His Car registration no was TTW 166 GP( Chevrolet )  Licence No 402 404 6VV174 NR

He had confidential Papers in his Car, covering all the family’s private details.  

Because of the Serious nature of their actions and the Damages that have caused, and the risk to the Safty of the Owner of the home,  Criminal Charges have been laid against Mr Robert Andre Laubscher of Strauss Daly Attorneys,  and Mercedes Benz Financial Services  and Mr Rick Mannie.

This was the most dishonest corrupt and unethical  lawyer ever to practice in South africa. His major client was Standard Bank, Standard Merchant bank and FNB Bank.

The said three banks knew he was unethical and dishonest, but used him because he could get a judgement against one of their clients without delivering a summons.

He had it all worked out with the two Banks. He would issue a summons and have it stamped at the Supreme or Magistrates Court. He would then pay of the Messenger of the court or the Sheriff to give him a return of service with Delivering a Summons. Armed with this he would obtain a judgement and deliver the final order to the person concerned.

Hundreds of judgements were obtained in this way with the full knowledge of the Standard Bank and First National Bank,

We can only thank God that the Pretoria High Court Judges Eberhardt Bertelsmann and William de Villiers found him to be danger to Society and an Embarrassment to his Profession and had him struck off the roll.

We still have hundreds of Lawyers in South Africa doing the same thing.
