Threatening Telephone Call from Eben van Wyk of Cliff Dekker Hofmeyr  on behalf of MWEB to :

UIDIP and ISPE Board Member

 

I am a board Member of the International Society of Professional Engineers, a Board Member of the Union Internationale Des Ingenieurs Professionnes  and a Berufsingenier in Deutschlands.

 

I had a call fron a Eben van Wyk who was very aggressive,  incoherent and proceeded to inform me that he was a Senior Partner of Cliff Dekker Hofmeyer and I should know how important he was.

He demanded that I remove his Clients Blacklisting ( MWEB ) from a  site that is not Controlled or owned by myself. He seemed to be confused about the International Legal System on Domains etc.

Her stated that if I did not remove his clients Blacklisting he would sue me and destroy me and even have me F----d up.

He would come looking for me and have me hunted down by his contacts from Cape Town

He is clearly a very dangerous man, and I will take the precautions required in view of this serious threat. Costs will be for MWEB.

I  had a call from a very arrogant  man who stated that he was the Senior partner of Cliff Dekker Hofmeyr and how important he was.

He told that unless I removed the MWEB listing on our WEB site he would have me F----- up and he would take everything I owned even the Clothes off my back. He stated that nobody F---s with him.

He was slurring his words and very aggressive his as if he was drunk. I am taking precaution and will now carry a firearm because he appears to be very dangerous and violent man

I refer to the call you made to my carry phone at 08:48 on the 31/10.2011 

I refer to the your remarks, which indicated to me that you were either confused or you were or had been abusing the bottle or playing with the white powder. 

I demanded who you were because of your abrupt, arrogant and you had a confused attitude. 

You stated that you would ‘’f --- me up and that I was a Black Bastard’’ . You also stated that you would ‘’ come and look for me’’.

It was clear that you were either sick or needed help for your problem

You also stated that you were a partner of Cliff Dekker Hofmeyr and how important you were and that that nobody ‘’f---s with you’’
PEP,  N & S, ISPE are Registered in the USA, and are domicile in the USA.
You are welcome to take the matter further and we would welcome such an action in an American  Court.
I have given instructions to extend the blacklisting to all our WEB sites ( 96 of them in 60 countries / states ) and to Google your name and send it to 550 search engines. You and your client can have some legal fun with this.

However stop wasting your Clients money, and give them some Professional Advice, to settle their Outstanding bill and also Apologise for the 3rd World  Service they offer the South African Public, and return the domain that they have stolen. This would not be acceptable in the Free World, and First World countries.

We trust that you have not charged your Client for your legal service to date, because it seems to be very unprofessional..
We look forward to your client transferring the said outstanding sum and the additional Invoice which will be emailed to them.

A International member of our Association, was called by an Attorney in Cape Town  ( Eben van Wyk a Partner of Cliff Dekker Hofmey 021 481 6300  ) who threatened  to beat him up if he did not remove the advertising from the Site  - Name and Shame.

 MWeb put the advertising on a Professional Site illegally, which is shown below. The company Name & Shame is not owned or Controlled by our International Member and is not hosted in South Africa.

Dear Mr.xxxx 

Your e-mail to Goolam Mahomed dated 18 October 2011 refers.  

1) With regard to your claim to us for loss of services due to the disconnection of your account for non-payment.  According to the MWEB General Terms and Conditions which you signed and agreed to, clause 8 reads

“Should you fail to pay any amount on the due date for payment then MWEB may, without prejudice to any of its other rights and remedies:

8.5.1 take all such further steps as may be necessary to recover the outstanding amount from you, including without limitation the use of debt collection mechanisms;

8.5.2 suspend your access to the service or the use of any product without notice to you until such time as the outstanding amount has been paid in full; or

8.5.3 subject to clause 2, terminate this agreement with immediate effect. 

Based on this, MWEB Is in no way liable for any loss of service you may have experienced due to non payment. The onus to make prompt payment for the services you use is your responsibility, and any notification from MWEB on action to be taken against you for non-payment is a courtesy extended to you.  

2) With regards to your claim for a refund for a service, which you claim to  have not been using , but failed to cancel with us at any time during the last “ ten years”, the same General terms and conditions you agreed , states in Clause 2 that :  

2 Commencement, Duration, Termination and Cooling-off

2.1 The Agreement will commence on the Acceptance Date and endure indefinitely until it is cancelled as provided for in this clause 2, or otherwise provided in this Agreement. In the event that the product or service you have applied for is not activated within 30 (thirty) days of the Acceptance Date (or such extended period as MWEB may advise) due to an Uncontrollable Event, the Agreement will automatically terminate and no party shall have any liability to the other as a result of such termination. 

In addition I can find no record of any time in the past when you have queried this charge or brought to our attention the fact that you have been charged for something you have not been using. According to our records, the service was also only activated on your account on the 17th of March 2004, which according to our calculations is a period of 7 years and 7 months and not 10 years as you claim. However the period is not relevant, as the service was not cancelled. 

Please note that your account has still not been settled as per your agreement with Will Steffen and we will be suspending your account again on Tuesday 25th of October should not have paid in full.  I understand that you have cancelled your account, please also note we will not transfer your domain to you new ISP should you have a balance outstanding with us.

M Web business have failed to sort out a problem which has been going on for most of this year. We have been clients for the last 15 years since before MWEB started.( USCO PIXIE GLOBAL TISCALLI )  and we have seen their service both from a commercial and Technical level reduce to nothing.

The main problem is with the type of staff they employ, which while it may be politically correct, they lack any form of skills and basic intelligence, They have cost us thousands of Rands of losses and and wasted time. When phoning their call centre you receive a recorded message blaming Telkom for the problem. The main problem is that they have not integrated the various systems and Companies which they have. I fear that we will shortly see a complete collapse of the MWEB structure similar to the BlackBerry collapse we have just seen. we are receiving reports daily about them. .

They have 780 complaints listed on Hello Peter Complainte web site :  www.hellopeter.com

Their staff are untrained and have a attitude of '' Tell the Client anything '' and hope they go away.

Our issue which is also affecting Thousands of South Africans is the same problem they have in their associated Company MultiChoice  both on a Technical and Administrative level.Multichoice have 2919 Complaints listed against them on Hello Peter  - www.hellopeter.com

They need to dismiss their entire staff and appoint people because of their ability and not because it is politically correct to do so.

You will see the problem we have, and we have to ask why are we paying MWEB and why are we paying for a limited poor service and having a PD in a position to cut us off from the World when it pleases him.

A. This is what we get from IPO1 in the USA which makes the MWEB poor and restricted service a Joke. It also takes them no more than 20 minutes to resolve a problem ( MWeb 72 hours if you lucky and in most cases they never respond )

B. The cost for this world class service almost unlimited is $95.88 ( R 680-00 at the time of payment ) per year and MWEB’s bad service is R 358-00 per month.  

C  For R 387-00 per Annum we can buy a one Page Hosting ( or Pointing to our American Site ) You restrict us to 20Mb which is nothing and Cut us off. 

D. Google web mail service is free service and as shown below we are using 97Mb of our 7636 MB  

E. Webmail service is free and we have 10GB 

F. All fax to email services are free in South Africa except MWEB are charging us R 39-00 per month and half the time it does not work because of PD trouble. We must have paid this for at least 10 years.

We have to ask, have we been screwed by MWEB over the last 14 years as a Loyal customer. I’m very sorry to hear that you have come to this juncture as we would obviously not like to lose you as a customer. 

I did make some enquiries last week as to the nature of the legacy free mailbox products which you have and the problem you have been encountering with the 10mb size limit on these mailboxes. It seems that these products do not cater for a size change.  We would have to arrange for them to effectively be recreated and I would have to get approval from one of my colleagues in the Business division for them to remain as a free product, which I was about to make enquiries about. 

If I could arrange this for you would it influence your decision, or do you feel that the best way forward for you is to consolidate your services with the US providers that you have?

Thankyou for all the help you have given us, it is a pity they don’t employ more people like you to run MWEB. 

M WEB have become a high risk company for Internet uses and email and Internet uses in South Africa.

This last year we have seen bad service, very poor no care attitude from the staff in the Call Centre very poor Internet service  and everybody is talking about it.

This rubbish of sending back emails down our line ( Profeng 1 to Profeng 9  ) because of a 10MB restriction is also new and never seen in 14 years. Our free hostings at GMAIL or WEBMAIL are giving us 7335MB of space.

Our site hostings in the USA are unlimited.

MWEB caused havoc last  week by bouncing back very important emails. It caused us losses of about R10,000-00. The attitude of the PD’s which we have in the new corporate South Africa has no place in our business. It has caused me many hours of meetings trying to recover last business.

We need to cancel and rearrange our relationship of 14 years as the risk is too high to have your PD’s controlling our business.

We have therefore alerted everybody about the MWEB situation and have changed most of our daily incoming mails and email addresses on our sites World wide.

We need to remove the ADSL part of the service as we have given up the poor Telkom service. We advised MWEB about 2 months ago.

We need to remove and cancel our Fax Number 011 507 6821 from MWEB.  

Our Fax number which we are paying R 39-00 a month to MWeb for will be replaced with a better service from Webmail Fax Number 086 xxx 6148  and we will received it as a email on a new web mail account enginements@webmail.co.za  a fee email account which cannot be cut off as you admin staff have done to us a number of times this year.

Our website hosting needs to be secured as MWEB’s service is not secure and the South African Client is at high risk hosting their sites with MWEB.

Our sites in the USA are about 7.5% of South African hostings costs  and problems are solved in no more than 30 Min ( MWEB 72 hours and in most cases no reply ).

Please advise us on what we should do as we cannot have your PD’s suspending our site. This is unacceptable in South Africa.

A charge sheet has been sent to Ms Mohlala – NCC Commissioner with our complaint and demanding that MWEB be fined the Maximum fine.

Herewith a summary of the problem: 

When investigating the issue of our customers mail being rate limited by our SMPT servers we uncovered the following issue: 

We noted that the emails being sent did not originate from the customers IP address, but rather from a common address on the CellC network, namely 41.157.82.7.  Over the course of the time period we extracted logs for we noted somewhere in the region of 6000 emails originating from this IP address and a significant portion of the mail seemed to be registering as spam.  Our assumption is that this address relates to some type of transparent cache or aggregation point on the CellC network rather than a single user.  This poses a problem in terms of the manner in which our spam filters and rate limiting operates and we will need to seek CellC’s co-operation to come up with a suitable solution to the issue. 

Further to this we also noted that our customer seemed to have problems  initiating network traces to portions of MWEB’s network and sending authenticated mail through an alternative server, which again indicated that there might be some type of aggregation technology affecting the connection. 

On the trace that was provided me (below) I’ve also noted that the latency on portions of the path becomes very high, which is a cause of some concern and could indicate an underlying problem.  Again we would need feedback from CellC on the matter. 

I am copying in both the customer and the senior manager in our Technology division responsible for mail infrastructure on this communication.  Please could you assist us with this matter, or provide us with the relevant contact points within Cellc’s NOC that we could take the matter further with.

Just to clarify my concern I understand that this traffic does not originate from one of your servers. 

However what we noted is that the mail originating from this IP address seems to originate from multiple CellC subscribers and is being sent directly via MWEB’s outbound mail servers.  I assume that this is because these are customers that we share and they are making use of MWEB mailboxes and server settings (as with Mr Hosking).  The problem comes in whereby we apply a rate limit on our servers of 400 messages per hour based on the originating IP, however the traffic from multiple CellC subscribers being aggregated by your NATing solution is regularly exceeding this limit which causes individual customers to have their mail rejected for exceeding the rate limit. 

As we are not the only ISP who implement this type of rate limiting I would assume that this problem could be experienced in any scenario where CellC customers are utilizing an alternative smtp server.  In my experience roving customers who use an ADSL connection at their home base and a 3G connection when on the move prefer to keep a single set of mail server settings so it is not realistic to ask these users to change the outbound mail server based on their network so ideally we need to work together to come up with a solution to this. 

Can I suggest that you provide us with some telephonic contact details so that someone from our mail team can discuss this issue with you in a bit more detail and we can work together to find a solution?

Your email has been forwarded to me and I would like to respond.

First of all, the IP address mentioned, (41.157.82.7) is not a server from CELL C, it comes directly from a 3G subscriber. We source NAT any outgoing SMTP traffic behind the range 41.157.82.0/24 to distinguish it from browsing traffic. If you see this range on your side, the only device it would have passed, is a firewall, but is basically directly from a subscriber. Our subscribers official MTA’s are

41.48.9.21, 41.48.9.22, 41.157.66.21, 41.157.66.22, 41.50.9.21,22(future) 

Our MTA’s has some spam control and that will be the reason that spammers don’t come right to send out 1000’s of spam via our MTA’s. Then they start sending it out directly from the pc’s. 

I will find out if there is any more controls that we can put on SMTP traffic which does not pass by our MTA’s.

We cannot block it because there are legitimate subscribers which sends out via authenticated servers. Not sure if you allow it from this range or if you blocking it now. 

Also we can assist with some tracing to your server if you provide some more details.
