Breach of Purchase Contract : Refusal to Service the Car and Refusal to Carry out the 3 year 75,000KM service all of which is Documented / Complaint against Dr Martin Zimmermann CEO Mercedes Benz South Africa

They refused to carry out the 3 year 75,000km service in terms of the Contract and the Service contract. This is in contravention of various sections of the National Credit Act 34 of 2005  and various sections of the Consumer Protection Bill 68 of 2008 and in direct violation of the Constitution of the Republic of South Africa Act 108 of 1996 and its various amendments.

The Previous Commissioner Adv Mohlala  was aware of the Complaint. 

We have made repeated requests to Mercedes Benz to sort out various problems and to date no reaction.

We have also forwarded a Letter of Demand to their CEO Dr Martin Zimmermann a German National, and there has been no response to our Complaint.

It is clear that he has a no care attitude to the Problem and a total disregard  to the Laws of South Africa or any of the Acts in place to protect the South African Consumer.

We are there demanding from them you the sum of R 250,000-00 (Two Hundred and Fifty Thousand Rands) damages and a public apology.

Additionally :

We think it is time that the NCC made an example of Mercedes Benz and levelled the Maximum Fine  of 10% of their turnover plus a fine of R 5,000,000-00 on Dr Zimmermann.  

They are also in Contravention of Section 68 of the National Credit Act 34 of 2005

                           plus a Armed Attack with Firearms on my home and placing the safety of my family at risk.

Because of the Serious nature of their actions we have forwarded the case to the NPA, for Criminal Prosecution. 

They are also in contravention of the FICA rules, and a separate Case has been opened, demanding a full FICA Audit. 

They have  has not responded to any of our emails, or requests for a meeting. We have been unable to get Dr Martin Zimmermann to answer any of our emails ( see PDF File attached ) and visit   http://www.nameandshame.biz/mercedes.htm  He hides behind a lady called Karola Block who blocks his calls and emails.

Criminal Charges have been laid against Attorney Robert Andre Laubscher and Mercedes Benz Financial Services for hiring a professional Hit man a  Mr Ricky Mannie armed with a firearm with instructing to Break in the private residence of the Owner of the home who is not Connected with either Organisation in any way.

At 12:15 a Mr Ricky Mannie ID No D no 621115512082.of Tim Risk management on the Instructions of Mr Robert Andre Laubscher and Mercedes BRobert Andre Laubscher -  Director Corporate Recovery Strauss Daly Attorneys and Mercedes Benz Financial Services Pretoria ens Financial Services armed with a firearm overrode the Perimeter Security System and  broke into the premises of a long standing client of Mercedes Benz.

The Safety  and Security of the Family was jeopardised in the Attack. It is Clear that this Attorney has a no care attitude to the laws of the Land. 

The Hit man tried to escape by reversing at high speed down the driveway and was apprehended at 12:19 in the Driveway. He stated that he was working for Mercedes Benz Financial Services and Strauss Daly.

His Car Revealed that :

He had House Breaking Equipment and tools in the Car.

He was in possession  of Remote Control Devices and Car Jam- locking System devices.

He had an Electronic Scanner in his car for overriding Alarm Systems.

He stated that he worked for Mercedes Benz and on inspection he was carrying an ID no 621115512082.

His Car registration no was TTW 166 GP( Chevrolet )  Licence No 402 404 6VV174 NR

He had confidential Papers in his Car, covering all the family’s private details.  

Because of the Serious nature of their actions and the Damages that have caused, and the risk to the Safty of the Owner of the home,  Criminal Charges have been laid against Mr Robert Andre Laubscher of Strauss Daly Attorneys,  and Mercedes Benz Financial Services  and Mr Rick Mannie.

Mercedes Benz Refuse to service Cars - Breach of Contract

I booked my Mercedes Benz for service at the Mercedes Benz centre in Bryanston. ( 3years 75,00 km although the car has only done 35,000km )

I was later called by the service department  manager Mr Viz Pillay who refused to service the car as he said I was lying as regards the KM that I have given. We believe that this was racially motivated as was the previous encounter we had with him.

We have received a letter on 15^th June 2008 from MBenz Financial Services signed by Lin Reed Management Board Member informing me of an Interest rate Adjustment on my MBenz car loan.

I paid off the car early in October 2007 ( at 32 months, of a 60 month contract ), which was 8 months ago as I was not prepared to deal with a company who violated their clients and failed to Comply with the requirements of the National Credit Act 34 0f 2005.

All the dates shown in the letter don’t tie up indication gross incompetence.( They have recreated letters changing and backdating dates before )

Even in settling the outstanding amount, they misrepresented the facts and penalty interest ( They fine you for paying off a car early ) and took a further payment from my bank after I had settled.( We have a email stating that they would not take any further payments.

They have illegally removed money from my bank account for insurance, sent registered letters of demand for Insurance premiums when they were up to date then under threat of legal action from me refunded the money. They have back dated insurance letters, removed increased Insurance premiums and taken out double They have showered me with gifts, to stop me exposing them and the list goes on. When I purchased the car they misrepresented the facts in their adverts, the interest payment does not tie up with the monthly payment and then demanded a further deposit, They told me I was buying a new 2005 Elegance model, but all the documents show it as a 2004 classic.

I am making application to the National Credit regulator to have you removed as a credit provider, will full Google Publicity We will also recover the money owed to me using the small claims court with maximum publicity

This must be the most dishonest and Incompetent Company in South Africa
