We refer to our email dated 20^th March 2014 to which we have not had a replied to. 

You have major corruption at your Courts and you are failing to deal with it. Mercedes Benz have paid off the South African Police and the Court Prosecutors, and you are taking no action.

This is a Major case of  Malicious Prosecution and we are going to join all parties to our claim. ( it is like the bakery case that Yusuf Baba was involved in )

I refer to your email below to Mr Hxxxxxx which makes no sense at all, except that you state that the ‘ Chief ’ is the man responsible for all final decisions. 

You and Mr ‘Rassie’ Erasmus both of the Randburg Magistrates Court and  Rachel Kau, at Alexandra Court no 3, seem to use the ‘Chief’ as a Cover story for everything.

We would query if the ’Chief ’ has in fact  seen the Dockets or received the four Representations made to him in the matter Sandton CAS 709/10/2012.

We know for a fact that the ‘Chief ’ could not have made an educated informed decision on the two cases mentioned below, because a great deal of evidence has been concealed from the Docket by the  South African Police and the Prosecutors. 

We also know, with written proof and confirmed in Court under oath, that the South African Police have been paid to carry out this attack, with false charges by Mercedes Benz. 

There is in fact no case, but a paid vendetta by Mercedes Benz, the reasons for which are well documented with all the proof.  

This story reads like the Bakery Case (as per the attached emails) which you must all know about. 

We place on record that the Investigation officer on both the cases below is Dt. Sgt Tercia Nkabinde of Sandion Police, who has a number of Criminal Charges against her, including CAS 90/11/2012, OB 249/11/2012, CAS76/11/2012 . We also confirm that Mercedes Benz paid a Mr  Ndou at the Randburg to drop the charges against her on one case.  

Professionally and ethically this is highly irregular and unprofessional, and would not happen in any other Country. 

CAS 77/ 11/2012 OB 249/11/2012  State / M.D.Hxxxxxx vs Rickey Mannie. 

No decision could have been made by the Randburg Prosecutors, nor could the ‘Chief ’ have confirmed the findings, as the Police Officer had  concealed evidence and failed to file the Additional Charges and the Affidavit filed at the Sandton Police Station. 

They were filed on the 5^th February 2013 and sent by email to Brig. Billings on the 6^th February 2013 at 10:00am.  It included a Ballistic report. Rassie Erasmus had copies given to him on the 7^th February 2013. 

The  Forensic Inspection carried out on the 14-02-2013 by Lt Col Pillay and an unknown investigator and Sgt Nkabinde ( See Photographs ) after receiving our Ballistic Report on the 6^th February 2013 ( additional Charges against the Complainant )  by email is missing from the docket 

An  Affidavit  to confirm that there were no shots fired was given by Mr Mathew Morrison of Unit 7. He is a partner of Edward Nathan Sonnenberg – Africa’s Largest Law Firm.

The statement was given to Sgt Tercia Nkabinde of the Sandton police station on the 14-02-2013. ( see attached email of the 5^th July 2013) which are not in the Docket. 

It was confirmed that no shots were fired by both Reports. She Concealed this from the Court on the 14^th August 2013. 

An Affidavit dated the 5^th July 2013 and filed by Mr Mathew Morrison and given to the Investigation officer is missing from the Docket. 

This would have confirmed the Additional Perjury charges and fraud and the main charges against Mr Mannie. 

So Mr ‘’ Rassie’’ Erasmus, where are all the Missing Documents, which were given by Mr Hxxxxxx in the Presence of Cheryl Loots ( Then Chief Magistrate ), a family member and myself in Mr Erasmus’  office on the 7^th February 2013 ( 6 files and a DVD ) ?  

Is this why you transferred Mr Hxxxxxx’s case to Alexandra Court to conceal what we had given you on his case against Mr Mannie? 

All the Documents have also been emailed to Brigadier Billings, the Sandton Station Commander of the South African Police,. Brigadier (Advocate) Denise Beukes (B.iuris, LLB, LLM)  Office Head for the Provincial Commissioner Gauteng, 16 Empire Road Parktown  Johannesburg. ( With Documented Proof )

They were also Collected by hand by Col. Hendrick de Jager on Instructions of the National Commissioner on the 7^th October 2013.

They have been given by hand to the Prosecutor Rachel Kau, at Alexandra Court no 3 

Therefore no decision could have been made on this case, without all the above mentioned documents. 

What kind of Court are you running in South Africa?  Is it what they call a Kangaroo Court?

Rickey Mannie..

Rickey Reginald  Mannie broke into the Accused’s  house on the 14^th September 2012.

He Opened a case against the Accused on the 20^th October 2012 (36 Days Later ) – This is the first bad smell on this fabricated ‘attempted Murder’ case, and you all should have been alerted that this was a fabricated Vendetta case. 

Any normal person who had a shot fired at him would have reported it immediately, and not waited 36 days while creating the story. 

If you, Mr Yusuf Baba and Mr Erasmus, Rachel Kau and then the ’Chief’ had all read the Complainants Affidavit ( A1), and then the Complaints Affidavit ( A5), the first question you would have asked was - When did the Alleged Shooting take place?

Because the Complainant did not know, and he did not know who he worked for and his witness does not exist. 

In his Affidavit he signed on the 14^th October 2012 at the Honeydew Police Station and filed in the North Gauteng High Court he says that the accused  fired a shot at him on the 3^rd October 2012. ( A 5 )  

In his Affidavit he signed at the Sandton Police Station he says the accused  fired a shot at him on the 14^th September 2012.  ( A 1 )

In this Affidavit he leads everybody to think he works for Mercedes Benz, but in the Affidavit prepared by Mr Robert Laubscher of Strauss Daly ( Mercedes Benz Attorney ) he states his Instructions were received from Tims Risk Management.  

Who does he work for? 

In his Affidavit A5 paragraph he states that he has a Witness, and in Sgt Terica Nkabinde Affidavit A11/1 Paragraph 4 she states that they visited the witness ( This is a false statement by Sgt Nakabinde as it does not tie up with her Affidavit A6 ) 

Sgt Nakabinde has failed to state or attach the Affidavits signed by both owners of unit 2 at the Sandton Police Station on the 6^th July 2014, attaching their Air Tickets that they were not there.

Therefore the Complainant and the Police officer have lied in their Affidavits and have concealed Evidence from the Docket.

Why did the two of you and the Chief not pick this up?  Did you read any of the Statements? 

The Complainant also made a fool of himself as a State witness in Court, as he did not know  which day the alleged shooting took place or who he worked for, he mentioned two different types of guns, on various occasions, and lied about his Employer. He described the Scene of the shooting, which would be impossible .The second state witness, confirmed that the first state witness was lying in Court. 

The SAPS statements in the Docket don’t refer to this case at all, but they are responding to charges against them in another case which the accused filed, and have taken entire sentences out of the Accused’s affidavit and used them.  

We are responding to her Affidavit  in public .She has lied more than 20 times against herself and the other two police officers. Why did you not pick it up, or have you not read anything in the docket ?. 

Therefore where are the following Documents which should be in the Docket ? 

Where are all the Missing Documents, which were given by Mr Hxxxxxx in the Presence of Cheryl Loots ( Then Chief Magistrate ), a family member and myself in Mr Erasmus’  office on the 7^th February 2013 ( 6 files and a DVD )? 

After they were handed over to you Mr Erasmus, you stated that you were referring them to the ‘Chief ’. From the time of us giving them to Mr Erasmus and him  referring them to the ’Chief ’ and returning them to the Prosecutor it took 11 minutes!

This is not possible as it would have taken a very highly qualified attorney at least 3 hours to Study what we had handed over.

Therefore it is clear that the matter was not referred, although Mr Erasmus informed the Court that you had referred them. 

Is this why Mr Erasmus transferred Mr Hxxxxxx’s case to Alexandra Court to conceal what we had given you on his case against Mr Mannie? 

1.) The two Affidavits signed by both owners of unit 2 at the Sandton Police Station on the 6^th July 2014, attaching their Air Tickets that they were not there. 

2.) The  Forensic Inspection carried out on the 14-02-2013 by Lt Col Pillay and an unknown investigator and Sgt Nkabinde ( See Photographs ) after receiving our Ballistic  Report on the 6^th February 2013, confirming no shots were fired...

We also ask why is this Case continuing? Is it because of the Payoffs made by Mercedes Benz to the Police and Prosecutors ( we have written and Documented proof ) or is it because of the Civil Claim against the SAPS in terms section 3 Act 40 of 2002 for R17,188,250-00 ?

What kind of court are you running in South Africa? Is it what they call a Kangaroo Court ? 

Mr Hxxxxxx is in Court again on Tuesday 25^th March 2014 for the 17^th time on a False Charge paid by Mercedes Benz , and heads are going to roll.

Legal eagle falls prey to Hawks

A Protea Magistrate's Court senior public prosecutor, Yusuf Baba, has been arrested and charged as the net closes on a syndicate of allegedly corrupt police, prosecutors, attorneys and businessmen.

Baba, a former attorney, was released on R1000 bail on Friday shortly after being arrested by the Hawks on charges of fraud and extortion.

He joins 14 others in the dock, including former West Rand chief prosecutor André Lamprecht and his son, senior prosecutor Adriaan Lamprecht, Lenasia detective Moses Moshe Matsau, police officers Edward Cork, Johan Smit, and Takalani Lusumzi, businessman Shaun Tuna, his employees Asfaq and Nomi Mashi, and Vusi Masina, and Tuna's business associate, Ayub Mohammed.

The accused face 40 charges, including racketeering, defeating the ends of justice, corruption, extortion, and conspiracy to commit these offences in January 2009 and December 2010.

The extortion charges relate to the persuasion of Pakistanis, allegedly detained under false charges, to make false statements about Tuna's business rival who opened a bakery in competition to Tuna's.

Prosecutor Patrick Nkuna told the court that Baba was told by Lamprecht junior to persuade the Pakistanis to make false statements.

Representing himself, Baba said he would plead not guilty.

He said that he had been told that he was to be a witness in the case. The accused are scheduled to return to court on March 30.

Chief Justice Mogoeng Mogoeng has admitted that the judiciary is not efficient and pleaded with judicial officers to embrace quality and speedy service delivery.

Mogoeng told magistrates attending the Judicial Officers Association of South Africa (Joasa) gala dinner at the Kopanong Conference Centre in Benoni, east of Joburg, on Friday that he was shocked at the level of inefficiency in the judiciary.

Joasa, the representative body of magistrates, held its annual general meeting this weekend.

“There are a number of factors influencing the performance and under-performance of the judiciary. The under-performance of one or two courts undermines public confidence in the entire court system.”

Mogoeng warned: “We can’t afford to be associated with absenteeism, any form of irresponsibility or dereliction of duty or poor performance.”

He said court interpreters were poor and that the judiciary should take over the interpreting services from the Justice Department.

“People lose cases because of interpretation. That is a serious problem,” he said. “I don’t know who trains these people.”

Mogoeng also said the quality of police investigations caused delays of cases in court.

He slammed cops who continued to investigate cases when they were already in court.

According to Mogoeng, while judges and magistrates were independent when it came to taking decisions on cases before them, they were not free to take as long as they wanted to finalise cases and deliver reserved judgments.

“The South African judiciary will never be as effective and efficient as it can be, for as long as it is still not a single unified unit,” Mogoeng said.

A single judiciary would mean one governance framework for judges and magistrates, application of a uniform complaint handling mechanism and streamlining courts to establish a unitary system.

Last year, some of the country’s more than 2 000 magistrates embarked on an unprecedented strike over wages.

Mogoeng said magistrates’ dignity had to be enhanced, and remuneration packages and employment benefits should match their enormous responsibilities.

“Significant improvement is required in the provision of resources necessary to raise their performance levels,” he said.

Mogoeng promised to work towards a salary dispensation that reduced the salary gap between judges and magistrates.

“I’m not running for any office, I’m not a populist. I’m not saying things so that you can clap hands,” he assured magistrates.

Earlier, Deputy Justice Minister John Jeffery said it was not feasible to extend judges’ benefits to magistrates.

Magistrates earn between R700 000 and just above R1 million a year based on seniority, while judges are paid between R1.5m and R2.4m, in Mogoeng’s case.

Judges are also guaranteed a salary for life, which is not the case with magistrates.

“No country has an unlimited public purse,” he said.

Jeffery urged magistrates to engage the Independent Commission for the Remuneration of Public Office Bearers rather than go on strike. “Industrial action is improper, judicial officers are not employees,” said Jeffery, adding that magistrates’ demands had to be resolved through positive engagement.

Jeffery pleaded with magistrates to improve productivity of courts to eradicate backlogs.

He said average court times had dropped in magistrate’s and high courts despite administrative functions being removed from judicial officers.

 The legal thug ( Gerry Basson ) of Garry Basson Attorneys Randburg  works for Top Legal companies doing their dirty work sending around the Heavy's and breaking into houses.

He issues False Summons, gives a false Physical Address and Box Numbers, and false address for the Plaintiff, so that you cannot defend the action. He has made it his business and makes thousands of Rands a month from this.

 He also obtains Judgements against people without delivering the summons, in view of his relationship with the Sandton Sheriff, who gives false returns of service..

Ms L.Havenga of Mac Roberts Inc Pretoria the Attorneys who represents unethical and Incompetent Doctors, one of her Client being Dr M.L.Roberts   ( Anaesthesiologish ) ( and confirmed in writing  by L Havenga ) , instructed Gerrie Basson (of Randburg ) to issue a summons against me  although the Doctors  account had been paid on time and in full into the doctors Investec Bank Account, No 1001 1119 777 a year before in order to harass me.

This was a retalliation by Dr Weber after he had received the HPCSA  letter about our complaint. He instructed his Malpractice Attorney L Havenga of Mac Roberts Inc to issue the Summons via another attorney  in retaliation  of my complaint for Professional Services Rendered. ( copy of the summons attached )

Gerry Basson's member of staff has been filmed trying to break into houses to obtain Computer Equipment and Documents for his instructing Attorney. 

The courts know of his activities but as most Court officials are corrupt, he is allowed to Continue with his activities in the Randburg and Sandton Area.
