Breach of Purchase Contract : Refusal to Service
the Car and Refusal to Carry out the 3 year
75,000KM service all of which is Documented /
Complaint againstdr Martin Zimmermann CEO
Mercedes Benz South Africa
They refused to carry out the 3 year 75,000km
service in terms of the Contract and the Service
contract. This is in
contravention of various sections of the
National Credit Act 34 of 2005
and various sections of the
Consumer Protection Bill 68 of
2008
and in direct violation of the
Constitution of the Republic of South Africa Act
108 of 1996 and its various amendments.
The Previous Commissioner Adv
Mohlala was aware of the Complaint.
We have made repeated requests to Mercedes Benz
to sort out various problems and to date no
reaction.
We have also forwarded a Letter of Demand to
their CEO Dr Martin Zimmermann a German
National, and there has been no response to our
Complaint.
It is clear that he has a no care attitude to
the Problem and a total disregard to the Laws
of South Africa or any of the Acts in place to
protect the South African Consumer.
We are there demanding from them you the sum of
R 250,000-00 (Two Hundred and Fifty Thousand
Rands) damages and a public apology.
Additionally :
We think it is time that the NCC made an example
of Mercedes Benz and levelled the Maximum Fine
of 10% of their turnover plus a fine of R
5,000,000-00 on Dr Zimmermann.
They are also in
Contravention of Section 68 of the National
Credit Act 34 of 2005
plus a Armed Attack
with Firearms on my home and placing the safety
of my family at risk.
Because of the Serious nature of their actions
we have forwarded the case to the NPA, for
Criminal Prosecution.
They are also in contravention of the FICA
rules, and a separate Case has been opened,
demanding a full FICA Audit.
They have has not responded to any of our
emails, or requests
for a meeting. We have been unable to get Dr
Martin Zimmermann to answer any of our emails (

He hides behind a lady called Karola Block who
blocks his calls and emails.
