Re : Consultation set up for Mmmmmmmmm and
Dr. Birrel by Adv. Mullins and Attorney Ilze
Eichstadt on 2nd August 2010
I wish to refer to the consultation which
was ‘’ proposed ‘’ by Adv. Mullins and
arranged and set up between the attorneys
Ilze Eichstadt , Adv. Mullins and your self.
I was not Consulted in the matter at
all..
We place on record that the details of the
consultation was emailed to me at 03:04 on
the 25th February 2010 for an
appointment 5.5 ( five and a half months
later ) on the 2nd August 2010.
Firstly the attorney Ilze Eichstadt and
Adv. Mullins failed to verify your
Qualifications and Professional background
and experience together with your past and
present relationship with Dr Weber
Professionally and Ethically this is
unacceptable and seems to indicate a very
unprofessional attitude between the three of
you.
If a detailed verification which should have
taken place had taken place and they
continued with you and you continued with
the Consultation, then a Criminal
prosecution must be lodged against the three
of you.
The Lawyer and Adv. Mullins were
unprofessional for not informing you of the
Facts and what was required of you when they
made the appointment..
You were equally unprofessional for not
requesting details of what was required from
you and who the parties were .when the
appointment was made.
When the Brief /Letter was hand delivered to
you were made aware of the fact that the
Case lodged in the High Court was against Dr
Weber, and with this in your mind knowing
your views which you later confirmed in
writing ‘’ I would never give evidence
against Dr Weber ‘’( as confirmed in
your letter / report written by you ) you
should have immediately disclosed the
possible Conflict of interest with Dr Weber
and Informed Adv. Mullins and Attorney
Eichstadt and that you would never give
evidence against Dr Weber and returned the
files..
You should also have disclosed that :
You and Dr Weber were at Pretoria University
together and studied at the same
University..
That you co-proposed Dr Weber for his
Professorship, and that Dr Weber had asked
you to support him to obtain his
Professorship..
That you had not Practised as an Orthopaedic
Surgeon for 15 years. and had never appeared
in court or given evidence in matters
concerning orthopedic surgery.
That you had never done or had any
experience with Medical Malpractice Claims
or appeared in Court on other
Medical Matters.
That you only do reports for the RAF in the
form of Accident Reports and Claims
That you were not up to date with Hip
replacements and had very little knowledge
of ‘’floating’’ prosthesis
That you had informed L Havenga of Mc
Roberts ( Dr Webers attorney ) of my
appointment with you, resulting in Adv
Boikanyo advising me to be careful of my
Consultation with you. ( he gave me his
reasons which I will disclose to the NPA )
It now appears that she is your Attorney
as well.( Her written confirmation )
You should have disclosed your position
fully and declined the brief without any
further comment.
You accepted this brief under false
pretences using this as an opportunity to
try and rip off a member of the public for R
10,000-00 ( I am not certain what kick back
you had promised the Attorneys or what you
were going to give them )
You will recall that having spent 15 minutes
with you I was able to establish your
background and your relationship of many
years standing with Dr Weber and how little
medical experience you had in the matter in
question ( Hip replacements ).
You discussed the matter with a Dr Naude (
also a friend of Dr Weber ) without my
consent which in itself is medically and
Professionally unethical. Why did you do
this? Is your Medical knowledge so limited
that you needed to consult another ‘’
Doctor’’?
You nor did Dr Naude examine me and Dr Naude
( if he exists at all as nobody has heard of
him ) never contacted me. Neither of you
looked at or examined the 5 box Files that I
have with additional information or the 3500
Photographs or the other similar cases I
had received on Dr Webers other botch ups.
The Current position is attached :

May and the 28th May 2011 )
I am therefore demanding damages of R
5,000,000-00 from you.
PS :
HPCSA Section 23 Violation by Dr Weber
: For your information Dr Weber in in
violation of Section 23 of the of the HPCSA
rule in that he runs his own prosthesis
company from his Residential address and the
adjoining prosthedis mansion situated at no
6 amd no 8 Pallinghurst Drive Parktown. It
is shown and recorded in a number of medical
Journals and on the Internet. His Prosthesis
Company lists the postal Address as Sandton
Cliniv, and the phone numbers as his private
home phone number as shown on his CV and a
second phone connected to his surgery at
Sandton Clinic.
To date the HPCSA which is controlled by
McRoberts ( Dr Webers attorney ) have
refused to prosecute him on the section 23
violation. What does that tell you about the
Medical Mafia in South Africa?
