Abergate Screws up on a job and gets their  a pompous arrogant  Attorney to send a Lawyers Letter to the Client..

We refer to the Waterproofing Contract that you carried out on the Complex in General and on unit  6 in particular. 

As you can see it is a total disaster, which you and the body Corporate have known about since the 4th December 2012.

I also place on record my concerns as shown in the 2 emails shown below. 

As you can see from the Photographs sent on the 4th December 2012 to you and the Trustees and the Photographs attached to this email,  we have a major leakage  problem,  which is directly linked to unsupervised and shoddy workmanship carried out by your employees. 

It is also because of using inferior products.

The Entire ceiling in the lounge and dining room needs to be replaced and painted, the wooden flooring and trim needs to be replaced, and damage to furniture and carpets need to be sorted out. We estimate the total costs to be in the region of R150,000 (one hundred and fifty thousand rand only) 

We therefore insist that the position is corrected within 7 working Days. 

Failing which our Legal advisers Legal Wise, will Issue a High Court Summons or obtain a Court order forcing you to correct and restore the position.. 

All legal Costs will be for your / BC account.   

Action Required: 

To remove the Ceilings in the Lounge and Dining Room and Investigate where the water is coming from.

Remove all the waterproofing from the unit and have it Professionally redone under a Professional Engineer’s Supervision.

Replace the Wooden Flooring and trim.

Plaster of damaged Walls.

Have certain Items of Furniture re polished and the Leather inlay re treated.

Have the Tantalus restored.

Paint the new Ceilings with Double Velvet.

Issue a separate written 10 year Guarantee on Unit 6 so that we can proceed with our plans for the unit. 

This is a major problem with the unit, and is delaying our efforts to sort out a problem with the Complex. 

Your failure to give us a plan of action within the next 48 hours will result in me, without any further notification, instructing the attorneys to proceed, and having you Black listed.

Our client denies any wrongdoing, and in particular, denies your allegations of, inter alia, poor workmanship or the use of inferior products. 

Purely without prejudice to our client’s rights, our client is prepared to meet with you to inspect the work done and discuss your concerns at a mutually acceptable time and date. Please would you telephone Karen at our client’s office to set up a meeting in this regard. 

Please note that our failure to deal with any other aspects in your letter below must not be construed as an admission as to the correctness of any allegation therein contained, and all our client’s rights are strictly reserved. 

Please note further that should you proceed with any litigation as threatened, we hold instructions to vigorously defend any such steps that you may take, and seek an appropriate costs order against you. Our Emails are already published. To date Multichoice have had a no care attitude and we have had endless problems with their accounts. Rashida Adam  failed to sort out the Problem and settle the Damages Claim. This incompetent female than handed the matter over to their THUG lawyers Munnik Basson Dagama Inc and caused us a great deal of expense. She also listed us with sister company ITC. Their CEO has not responded to our Complaint and we have not been refunded our Damages Claim. It is the type of staff they employ who are destroying South African.

Attorney : Ahmed Amod

Johannesburg - The attorney representing airline Velvet Sky in a liquidation application it faces withdrew from the case on Tuesday.

"I have just signed a notice of withdrawal," said Ahmed Amod ahead of the application set down for Wednesday in the High Court in Pietermaritzburg.

He cited personal reasons.

BP Southern Africa has filed papers for the liquidation of the airline which has been flying for less than a year, because it is allegedly in arrears on its fuel bill.

On February 24 BP Southern Africa applied to the court for the provisional liquidation of the airline, which allegedly owes BP R29m for aviation fuel.

Argument is expected on Wednesday. Amod said he was still a director of the airline.

On Monday, the liquidators of Pamodzi Gold Mining Group announced they planned to lay charges of fraud against Amod, who is also a lawyer for Aurora Empowerment Systems, the company appointed to manage the mine.

Liquidator Johan Engelbrecht said the charges would also be laid against former president Nelson Mandela's grandson Zondwa Mandela.

Aurora's management contract was cancelled after the company was accused of destroying infrastructure at the mines. Over 5 000 people lost their jobs.

Amod said he had not been informed of the planned charges and Velvet Sky chief operating officer Gary Webb said earlier on Tuesday he was not aware that Amod might be charged.

He was feeling hopeful about the BP challenge on Wednesday, he said.

"We are obviously in the hands of the court, but we are optimistic about the outcome there," said Webb.

"It will take a couple of days to get ourselves back on our feet," he said when asked when the airline expected to fly again.

The airline suspended flights last Monday, and customers with tickets do not know if they will get refunds or be able to reschedule their bookings.

Velvet Sky's first flight left OR Tambo International Airport on March 22 2011. A few months later it was sold by Macdonald Holdings to Excalibur Aerospace.

A very cheeky female using the name of Stephanie Meadows who  purports to be the Manager of Arup Head Office Melrose Arch informed the Executive Director of the Professional Engineers and  Chairman of Professional Engineering Placements  that Arup Consulting Engineers did not Employ White Males, or have discussions with Executives of Companies who were White  or do business with companies that did not have a black ownership.

It is clear that the Arup Head Office and the HR Department is practising serious racism and racial discrimination and is a firm not to get involved in or for Engineers to waste their time sending your CV's to.

We refer to the telephone call from Ayesha Moosa of Arup to our offices on the 13th July 2011 requesting us to assist Arup in sourcing 3 top Professional Engineers plus a CAD Technician. Detailed Job descriptions were emailed to us by Ayesha Moosa  on three occasions ie  13th July 2011, 15th  July 2011 and the 18th  July 2011. 

We also refer to various other telephone calls and emails between 13th and the 28th July 2011 which are well documented.

Based on the urgency of their calls we sourced, interviewed and supplied Ayesha Moosa with 3 CV’s of Engineers with impeccable Credentials who could be placed at Director level or above in any organisation. 

To date we have received no feedback or comment to the CV’s and it is clear that Ayesha Moosa of Arup was fishing for CV’s or collecting CV’s.

Ayesha Moosa and her colleague Bongiwe need to be more Professional when working in a HR department. and dealing with the public. .

They also need to get a great deal more experience in HR before any further dealings with the public  

We are disturbed by this unprofessional behaviour as they are dealing with a Professional Placement Company ( who have been in business for 21 years ) and Professional Engineers, who should be afforded the courtesy of a response.

We are attaching our Invoice No PEP 036/20/08/2011 for the amount of R 21,000-00 for work carried out ( wasted costs ) which must be paid on presentation.

The fees bill remains unpaid.

In future any requests for sourcing of  staff must be accompanied by a holding deposit.
